Terms of Service

These Terms of Service ("Terms") govern your use of the Fice website at ficeapp.com (the "Service"). By using the Service in any way, you agree to these Terms. If you don't agree, please don't use the Service.

1. Who provides the Service

The Service is operated by Michał Piaskowski, a private individual based in Poland (the "Operator", "we", "us"). Contact: cognitra.adm@gmail.com.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age required to give valid consent for digital services in your country (16 in some EU countries), you need permission from a parent or legal guardian.

3. No accounts — your data is yours

Fice has no accounts and no cloud storage. All progress (sessions, coins, cards, streaks, settings) is stored only in your browser's local storage on your device. You are responsible for backing it up (Settings → Data) — if your browser data is cleared and you have no backup, your progress cannot be recovered by anyone, including us.

Fice includes virtual items (coins, cards, achievements). These items have no real-world monetary value. They exist only on your device, cannot be sold or redeemed for cash, and may change between app versions, including in response to bugs.

6. Content and ownership

The Service, including its design, code, 3D assets, card artwork, and copy, is owned by the Operator and protected by copyright. You receive a personal, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, or distribute the Service without permission.

7. Disclaimers

The Service is provided "as is" and "as available", without warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Use at your own risk.

8. Limitation of liability

To the fullest extent permitted by law, the Operator is not liable for any indirect, incidental, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to €50 or the amount you paid us in the past 12 months, whichever is greater. The Service is currently free, so this practical cap is €50.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be limited under Polish or EU consumer-protection law.

9. Termination

You may stop using the Service at any time — erasing your local data from Settings removes everything. We may discontinue the Service; we will give reasonable notice before doing so entirely.

10. Changes to the Service or Terms

We may update the Service and these Terms over time. The "Last updated" date at the top reflects the current version. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law and disputes

These Terms are governed by the law of the Republic of Poland, without regard to its conflict-of-law rules. If you are a consumer resident in another EU member state, you also benefit from any mandatory consumer-protection rules of your country.

For disputes, we encourage you to contact us first at cognitra.adm@gmail.com — most issues can be resolved informally. If a dispute cannot be resolved, the competent courts in Poland have jurisdiction. EU consumers may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
